General terms and conditions with gamemaniacs.se

1. General. These general terms ("Terms") below applies to the company GameManiacs HB org.nr 969668-2245 (”The Company”) and you as a customer when placing an order with us on our webshop www.gamemaniacs.se (”Webshop”). Detailed contact information and other information regarding The Company is stated elsewhere on the website. The terms and conditions only apply to you as a consumer when placing an order with us from the Webshop. In addition to the terms and conditions for our integrity policy apply. In this policy you can read about how we manage your personal information when shopping with us. As a customer shopping with us you need to be at least 16 years of age and not under any guardianship. If you are below 16 years odl you need parental consent to place an order with us. These terms and conditions may change at any time but the terms and condtions active when placing the order apply for that purchase. Any changes will be available for review from the latest published version of the terms and condtions on the website. Changes will take effect when acceptint the terms, for instance when placing a new order.

2. Agreement and ordering. In order to place an order via the Website you first need to accept the terms and condtions. After receiving the order The Company will send a confirmation to you via e-mail as soon as possible. No agreement has been struck until The Company has confirmed the order in writing and it has been received by you via e-mail. We retain the right to refuse an order in certain circumstances, for instance if we have received faulty information or if the order cannot be completed due to unexpected shortages.

3. Product information etc. We disclaim any liability for errors or omissions, including typographical errors, incorrect images, ads or other marketing information and product descriptions. The Company retains it right to correct these errors or change and update the information on the Webshop continously. All images on the Webshop, ads or other marketing material are exclusively to be seen as illustrations and not specifications of a products features, functions, origins or other form of guarantee. Further, The Company does not take any responsibility for information on the Webshop from a third party. All content on the Webshop is protected by copyrights, including product names, images, logos, layouts, information and brands by their respective owners. This means that these cannot be copied or used without written consent from The Company.

4. Price and payment. The prices on the Webshop at the time for ordering are fixed for the specific order unless agreed upon separately. All prices are either in Swedish Kronor (SEK) or Euro (EUR) and include Swedish VAT. The prices do not include possible additional costs for payment or shipment, these are stated separately. The total payable amount including these additional costs are however summarised in the checkout befor placing the order and also noted in the order confirmation sent by e-mail. The Company strives to keep the information on the Webshop as correct as possible, however disclaim any liability for errors regarding prices that are obviously incorrect. If an incorrect price hase been stated for an ordered product we will let you know as soon as possible and await your approval of the new price before considering the order accepted. You may pay for your order using any of the payment method in the checkout.

5. Campaigns, discounts and other offers. The Company can from time to time offer discounts or run campaigns and other offers for different products. For these products the subsidiced price stands only during the limited time noted in the offer or as long as the stock lasts. These offers cannot be combined with other discounts unless specifically stated.  

6. Abandoned cart. If you have placed products in the cart and not placed an order we will send you a reminder in the form of an e-mailed list over these products under the following conditions: You are a registered customer and have not declined marketing from us or that you have accepted marketing from us. You can decline marketing at any time using the ”unsubscribe” option in the e-mail you are sent. You can then re-create the cart with all products. If you do not want to re-create the cart you do not need to do anything. Price and availability are based on the situation when you placed them in the cart. We however reserve the right to change the prices in regards to offers or shortages.

7. Delivery. Shipping cost will be added to the order unless otherwise stated. The current shipment options will be available to choose from the checkout. Please note that some options may be limited. Delivery time is dependant on the chosen method of shipping, as stated on the individual shipping method. Unless otherwise stated we strive to ship the order within 1 working day if we have all products in stock. Also, delivery times are approximate and dependant on our suppliers. If your order will be delayed we will contact you as soon as possible. You are responsible for collecting the shipment within the alloted time noted in the shipment notification. The parcel is to be picked up by the customer personally using the correct identification and order information. Orders not picked up will be charged an additional 300 SEK (or 30 EUR) for return shipping, fees and handling.

8. Right of withdrawal for private persons. When placing an order from the Webshop you have the right to cancel the order with in 14 days without any specific reason apart from the situations described below. To use the withdrawal right you need to contact us withing 14 days of picking up the shipment. All goods returned need to be unused, if the packaging needs to be opened to check the function or quality you may do so but it has to be done as carefully as possible. If the product has been damaged or used beyond checking its function or quality The Company reserves its right to demand reimbursement for the value the damages have caused. Please note that some products are not valid for withdrawal: personalised products, products sealed for health & safety reasons, products that quickly deteriorate when opened or digital products. By accepting the terms you also accept that the right of withdrawal does not encompass these types of products. In order to invoke your right of withdrawal you need to contact us within the alloted time and state the order as well as your full name and contact information apart from a description of the problem. When returning products using the right of withdrawal you pay for the return shipping cost and you are responsible for that the products arrive safely to us. We therefore recommend that you use the original packaging for the return and send it as a trackable package.

9. Guarantee. For products that have a guaranteed life span this is stated separately on the product description in the Webshop. To invoke a guarantee you need to contact us with the matter and include proof of purchase as well as your information. Please not that special exceptions may apply for some manufacturers.

10. Faulty products. If you discover a product to have a fault you may contact us for replacement or repair within 3 years of the purchase. This needs to be done as soon as possible upon noticing the fault but within 2 months. We recommend that you examine the products upon receiving them and report any damages to us directly to the shipping company or pickup point and have them make a not on the shipping documentation. If you have received a faulty product contact us at info@gamemaniacs.se for further instructions. The Company does not accept COD shipments. When The Company has received the faulty product and deemed the claim legitimate we will either repair or replace the product according to law. If this is not possible or if The Company finds it more cost effective a repayment of the amount may be arranged, including return shipping costs. Please not that The Company has the right to deny a claim of faulty products and will in that case not repay any costs for return shipping or other costs involved in the return process.

11. Applicable law and legal dispute. If you have any questions regarding returns or other rights please contact our customer service. As a consumer you also have the right to contact Allmänna reklamationsnämnden (ARN) via arn.se or post to Box 174, 101 23 Stockholm. In the case of any legal dispute The Company will follow the advice of the recommendations of ARN. Further, you are as a consumer also eligible to file a claim with the EU's webbased platform för dispute settling at: https://ec.europa.eu/consumers/odr. A dispute between companies will be settled by a court.
These terms and conditions are applied according to Swedish law.
